Terms of Service

1. The agreement

The agreement is between you (or the business you represent) and Growth Coach. If you're using Growth Coach for a business, you represent that you have the authority to bind that business to these terms. We may update these terms; for material changes we will notify you, and your continued use after the effective date is your acceptance.

2. Your account

You are responsible for keeping your sign-in credentials secret and for everything that happens under your account. Tell us at hello@grwth.ch right away if you think your account has been compromised. We may suspend your account if we believe it's been used in violation of these terms or in a way that endangers the service or other customers.

3. Acceptable use

You agree not to:

Use Growth Coach to spy on people who have not consented to being observed under the legal regime that applies to your site's visitors
Install tracker.js on a site you don't own or have written permission to operate
Reverse-engineer, scrape, or otherwise circumvent the service for purposes other than legitimate auditing, security research, or interoperability
Use the service to send spam, host malware, or distribute content that is illegal where you operate
Probe, scan, or test the vulnerability of the service without our written permission
Misrepresent your identity, or use the service to impersonate someone else

4. tracker.js installation

You are responsible for installing tracker.js only on sites you own or operate, for complying with the privacy laws that apply to those sites, and for telling your visitors about the observation in your own privacy/cookie notice. If your jurisdiction requires consent before setting non-essential cookies (e.g. ePrivacy in the EU), you must obtain that consent before loading tracker.js.

You are the data controller of the behavioral data tracker.js collects on your site; Growth Coach is your processor and processes that data only as described in our Privacy Policy.

5. Connected accounts

When you connect a third-party service (Google Analytics, Stripe, Meta Ads, etc.) to Growth Coach, you represent that you have the authority to grant the access you're granting and that doing so doesn't violate the third party's own terms. We use those connections only to provide the features documented in the connector and our Privacy Policy. You can disconnect at any time from your dashboard; doing so revokes the OAuth tokens we hold and stops further syncs.

6. Your data

You own your content. By using the service, you grant Growth Coach the rights necessary to host your content, run the coach over it on your behalf, generate recommendations, and otherwise operate the service for you. We do not claim ownership of your content and we do not use it to train generalized AI models that benefit other customers — see our Privacy Policy for the specifics.

You can export and delete your data at any time. We will help.

7. Fees and billing

If your plan has a fee, you agree to pay it. We will tell you the price clearly before you commit. Fees are non-refundable except where required by law or where we explicitly offer a refund. We may change pricing on a going-forward basis with reasonable notice — your continued use after the change accepts the new pricing for future billing periods. Taxes are your responsibility unless we are required to collect them.

8. Service changes

We're an early-stage product. The service will change. We may add features, remove features, or change how features work, and we may run experiments. We will not make a change that materially degrades the core capability you're paying for without giving you a way to migrate or, if applicable, a refund of unused prepaid fees.

9. Termination

You can stop using the service at any time. Delete your account from the dashboard or email us. We may suspend or terminate accounts that violate these terms or that we believe pose a security or legal risk to the service or other customers. On termination, we delete your data on the schedule described in the Privacy Policy; clauses that by their nature should survive termination (e.g. data ownership, disclaimers, limitation of liability, indemnification) survive.

10. Intellectual property

Growth Coach (the service, the software, the brand, the dashboards, the coach prompts and methodology) is ours. Your content stays yours. Nothing in these terms transfers ownership in either direction. If you give us feedback, we may use it without obligation, but we will not identify you as the source without your permission.

11. Disclaimers

Growth Coach is provided "as is" and "as available". We make no warranties of merchantability, fitness for a particular purpose, non-infringement, or that the service will be uninterrupted, error-free, or that the coach's recommendations will increase your revenue or conversion rate. Marketing is not a deterministic system; the coach's output is advice you evaluate, not guaranteed outcomes.

12. Limitation of liability

To the maximum extent permitted by law:

Neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, even if advised of the possibility.
Our total liability for any claim arising out of or related to the service is limited to the fees you paid us in the twelve months preceding the event giving rise to the claim, or USD 100, whichever is greater.

Some jurisdictions don't allow these limitations, in which case they apply to you only to the extent permitted.

13. Governing law

These terms are governed by the laws of the jurisdiction where Growth Coach is operated, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of that jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property or confidential information.
